Cookies, Clear GIFs, and Similar Technologies: AV uses ​“cookies” and other website technologies on or in connection with the Services to support its Services. These technologies may collect and maintain information about you. A cookie is a very small text document or image file, which often includes an anonymous unique identifier. AV may use both​“session” cookies and​“persistent” cookies. A session cookie is temporary and disappears after you close your browser. A persistent cookie remains on your device after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Website or Services. AV may also use​“Clear GIFs” (​also called ​“web beacons” or​“pixel tags”) or similar technologies in connection with the Services or in its communications with you. A Clear GIF is typically a one-pixel, transparent image located on a web page or in an email or other type of message that helps to verify an individual’s viewing or receipt of a web page or message. 

AV uses cookies, clear GIFs, and similar technologies to administer the Services, monitor site usage and trends, analyze how you use the Services, maintain security, and engage in marketing and advertising services. 

We only retain your information for so long as it may be relevant for the purposes identified in this Policy unless a longer period of time is required by law. 

2. How We Use Your Personal Information  

We limit our use of your personal information to the purposes described in this Policy or other purposes, which AV will provide you before we use your personal information for such purposes. AV uses your information in the following ways: 

  • To provide, operate, monitor, maintain, and administer the Services; 

  • To administer our philanthropic activities, including grantmaking, contracting, and other payments to partners and vendors; 

  • To facilitate connections, relationships, and networks with persons interested in our work; 

  • To register participants for events and manage event logistics; 

  • To facilitate our partnership with affiliated entities, such as Action Now Initiative, LLC, Action Now, Inc., and the Laura & John Arnold Foundation; 

  • For marketing or advertising purposes, such as communicating with you via email or to promote the Website; 

  • To communicate with you, including to respond to inquiries you submit to us or to provide you with information or press releases when you sign up to receive information from us; 

  • To provide and improve necessary functionality of the Website; 

  • To promote the security of our Website and to investigate and prevent malicious, deceptive, fraudulent, or illegal activity, and enforce our terms and policies. 

  • For legal, regulatory, safety, and compliance purposes, including compliance with any applicable law or regulations; 

  • To administer recruiting, onboarding, employment, and benefits enrollment (where applicable); 

  • For other purposes about which we will notify you in advance or for which we receive your consent. 

3. How We Share Your Personal Information  

  1. Service Providers, Partners, and Associated Entities 

AV may use service providers to help it operate and maintain the 
Services. AV will only share your information with service providers in order to perform services on AV’s behalf and pursuant to our instructions, or to comply with legal requirements. The service providers that AV may share your information with include: 

  • Cloud hosting providers that provide data storage and/​or processing services; 

  • Website and system administrators to operate the Services; 

  • Corporate and information technology service providers to facilitate business operations and communications; 

  • Financial institutions and payment processors to process payments and reimbursements; 

  • Event management vendors to support event logistics and accommodations; 

  • Entities associated with AV, such as Action Now Initiative, LLC, Action Now, Inc., and the Laura & John Arnold Foundation; 

  • Analytics providers, like Google Analytics, to help us with analytics and perform analysis of how the Website is used or could be improved; 

  • Professional services advisors to protect and manage our business interests; 

  • Human Resource service providers to administer recruiting, employment and benefits programs (where applicable); 

  • Other suppliers, sub-contractors, partners, vendors, and service providers acting on our behalf. 

We may also disclose your personal information to our associated entities and business partners or associates to facilitate the Services as describes in Section 2. 

We may use and disclose aggregate statistical information that does not identify or otherwise relate to an individual, such as overall patterns or demographic reports that reflect user behavior and interest in the Services. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third-party tracking devices. 

  1. Third Parties 

We do not sell your personal information for monetary compensation; however, some laws broadly define ​“sale” or ​“sell”, and certain disclosure activities may, therefore, qualify as a ​“sale” even though we do not receive financial compensation for the exchange. For example, we share personal Information with our analytics and marketing partners to gain insights into preferences about our products and services, and for sharing advertisements of our products and services with you based on personal information we collect from your activities over time (also known as cross-contextual behavioral advertising or targeted advertising).

  1. Legally-Compelled Disclosures  

AV may disclose any personal information you may have chosen to provide when disclosure is: 

  • Reasonably necessary to comply with any applicable law or regulation; 

  • Required by law to comply with legal process, a subpoena, court order, or government request; 

  • Necessary to enforce our agreements and this Policy; 

  • Necessary to protect the security or integrity of the Services; 

  • Necessary to protect against harm to the rights, property, or safety of AV, its associated entities, you, or the public, as required or permitted by law; or 

  • Necessary to respond to an emergency, which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person. 

Where required or permitted by applicable law, AV protects personal information by requesting protective orders or confidentiality agreements, redacting personal information from documents prior to production or disclosure, or other legally permissible means. 

  1. Transfers 

We may share your information in connection with a corporate transaction, such as a divestiture, merger, consolidation, assignments or asset sale, or in the unlikely event of bankruptcy. In the case of any acquisition, we will inform the buyer that it must use your personal information only for the purposes disclosed in this Privacy Policy. 

In addition, we may transfer your information to entities associated with AV in order to allow them to provide or assist in providing any of the Services. These entities may be located in different jurisdictions than AV. In the event of a transfer of any of your information to any such entity, AV will ensure that the entity can and will provide the same level of protection for your information as AV. By continuing to use the Website or any Services, you consent to the transfer of your information in this way. 

4. How Long We Retain Your Personal Information 

AV will retain personal data for the period necessary to fulfill the purposes for which it was collected and processed, in line with the following requirements: 

  • Contractual Obligations: Personal information will be retained for the duration of the contractual relationship with the individual (e.g., customer, employee, or business partner). After the contract ends, the personal information will be kept only as long as required for post-contract obligations. 

  • Legal Obligations: Personal information may be retained to comply with legal obligations. This includes data retention mandated by accounting or consumer protection laws, where data must be kept for a specific period. 

  • Legitimate Business Interests: Personal information may be kept for a reasonable period after the termination of a contract or service to protect AV’s legitimate business interests, such as resolving disputes, managing legal claims, or improving its business operations. 

  • Data Subject’s Preferences: Where the data subject has consented to receiving marketing communications, personal information will be retained until consent is withdrawn or an opt-out right is exercised. 

  • Security and Risk Management: Personal information may also be retained to ensure ongoing security, auditing, and for the management of risks related to data breaches or other compliance obligations. 

5. Accessing Third-Party Services Through the Services 

The Services may contain links to websites operated by third parties, such as social media websites, and your personal information may be collected by those third parties if you use their websites. Should you choose to visit these third-party sites, you should review their privacy policies to ensure you understand and are comfortable with their practices concerning your information. We disclaim any and all responsibility for the privacy policies and information collection, use, and sharing practices of any third-party website (whether or not such site is linked on or to the Service). These links are provided to you for convenience purposes only, and you access them at your own risk. Any personal information collected by third-party websites will be governed by their respective privacy policies. 

6. Minimum Age Requirements to Use the Website 

The Services are not intended for use by children under the age of 16, and AV does not knowingly collect personal information from children under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us as described in the​“Contact Us” section below. If AV becomes aware that it has inadvertently received Personal Information from a visitor under the age of 16, AV will take steps to delete such information from its records. 

7. How We Protect Your Personal Information 

AV uses commercially reasonable and appropriate administrative, physical, and technical safeguards to protect the information that we have about you from loss, theft, and unauthorized use, access, modification, or destruction. We also require partners and third-party service providers acting on our behalf or with whom we share your information to maintain reasonable security and appropriate security measures. Notwithstanding our safeguards, it is impossible to guarantee absolute security. 8. Your Privacy Rights 

You have certain choices and rights available when it comes to how we collect and use your personal information. Below is a summary of those choices and rights and how to exercise them. 

  • Opt-out of marketing communications: You may opt-out of receiving any marketing communications from us in the following way: 

    • Email: You may opt-out of email communications by clicking on​“unsubscribe” at the bottom of any email. 

    • Contact Us: You may send us a request at privacy@​arnoldventures.​org to unsubscribe or opt-out of communications from us. 

Depending on your place of residency, you may have certain additional rights in connection with your personal information that we process. These rights may include: 

  • Right to Know the categories and specific pieces of your personal information we have collected in the previous 12 months. 

  • Right to Deletion of your personal information we have collected under certain circumstances. 

  • Right to Request Information about the collection, sale, and disclosure of your personal information from the previous 12 months. 

  • Right to Opt-Out of the Sale or Sharing of Personal Information we have collected about you. 

  • Right to Restrict the Use of Sensitive Personal Information (e.g., race, sexual orientation, religion) to only certain necessary business purposes (e.g., administering employment benefits, processing your request; ensuring data and network security). 

  • The Right to Nominate an Agent to act on your behalf with respect to your Personal Information, including to exercise any privacy rights applicable to you. 

  • Right to Non-Discrimination when exercising any of your rights. 

9. How to Exercise Your Other Rights 

To exercise the rights described above, please submit a consumer request to us by emailing us at privacy@​arnoldventures.​org or contacting us at Arnold Ventures, Attn: Communications, 1717 West Loop South, Suite 1800, Houston, TX 77027. 

You are not required to create an online account with AV to make a consumer request. 

Unless otherwise requested by applicable laws, you may only submit a consumer request (of each type as outlined above) twice within a 12-month period. The request must: 

  • Provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information or an authorized representative. 

  • In verifying identity, if the consumer is an AV customer or subscriber, AV will match the identifying information provided to the personal information AV maintains. If your are not an AV customer or subscriber, AV may use a third-party identity verification service which will ask the consumer a series of questions to verify the consumer’s identity. 

  • Indicate your request so that AV can properly understand, evaluate, and respond to it (for example, is the request to know, correct or delete personal information). 

We cannot respond to your request if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. 

We will only use personal information provided in a consumer request to verify the requestor’s identity or authority to make the request. 

We endeavor to respond to a consumer request within forty-five (45) days of its receipt. If we require more time, we will inform the consumer of the reason and extension period in writing. 

Please note that your request may be limited in certain cases, for example if complying with your request would conflict with: 

  • Federal, state, or local law; 

  • Regulatory inquiries; 

  • Subpoenas; or 

  • Exercising or defending legal claims.

10. Privacy Rights of Minors 

You must be at least 16 to subscribe to AV. Our Sites are intended for a general audience and are not directed to children less than 16 years of age. AV does not knowingly collect personal information from children. 

11. Changes to Our Privacy Policy 

We periodically review and update this Policy to describe new Services or changes to our practices. You can determine when this Policy was last revised by referring to the​“Updated” date at the top of this Policy. We encourage you to review the Policy whenever you interact with us to stay informed about our privacy practices and the ways that you can help protect your privacy. 

If we make significant changes to this Policy, we will notify you through a prominent notice on our Services or via email address or phone number you have provided. If you do not agree with the privacy practices disclosed in the Policy, we recommend you stop using the Website and Services.
