Washington, D.C. (Feb. 16, 2024) – We appreciate the Administration’s efforts to date to implement the No Surprises Act (NSA) and the release of the recent NSA Independent Dispute Resolution (IDR) data. As more Americans than ever struggle to afford their health care, it is important to continue to work to ensure the NSA both protects patients from surprise bills and does not raise health care costs over time. We look forward to evaluating these data in depth over the coming days. 

However, an initial review of the data raises concerns. It appears that repeated efforts to weaken the law through litigation and abuse of the IDR system by certain providers, including many backed by private equity, have resulted in payment determinations that are often substantially higher than in-network negotiated rates.”
